End User Licence Agreement

This page is a public summary. The legally-binding EULA in your jurisdiction is shown in-app on first activation and must be accepted before FoamSync can be used. If anything below differs from the in-app text, the in-app text governs.

1. Definitions

"Software" means the FoamSync application and the associated utilities distributed with it (Machine ID tool, diagnostic exporter). "Licensee" means the natural or legal person who accepted these terms on first activation. "Licence key" means the alphanumeric string or signed licence file issued to the Licensee.

2. Grant of licence

Subject to payment of the applicable fee and acceptance of these terms, the Licensee is granted a non-exclusive, non-transferable right to install and use the Software on the number of machines covered by the purchased tier. The Software is licensed, not sold.

3. Permitted use

The Software may be used to design, simulate and produce hot-wire CNC cuts from foam (EPS, XPS, PU and similar). Output G-code is owned by the Licensee. The Software itself, including its generators, post-processor and bundled assets, remains the property of Balcore Systems.

4. Restrictions

The Licensee shall not redistribute, resell, sublicense, or reverse-engineer the Software except as expressly permitted by mandatory local law. Licence keys are bound to a hardware identifier and may not be shared across machines.

5. Updates

Active subscriptions and perpetual licences purchased within the past 12 months receive updates at no additional cost. After the initial period, perpetual licences continue to function on their last covered version; further updates may require a renewal.

6. Warranty disclaimer

The Software is provided "AS IS" without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Hot-wire machinery is hazardous — the Licensee is solely responsible for safe operation of physical equipment.

7. Liability

To the maximum extent permitted by applicable law, Balcore Systems' total liability under or in connection with this licence shall not exceed the fees paid by the Licensee in the twelve months preceding the event giving rise to the claim. Mandatory consumer-protection rights remain unaffected.

8. Governing law

This licence is governed by the laws of the Federal Republic of Germany, with venue in Frankfurt am Main, except where mandatory consumer-protection law of the Licensee's residence provides otherwise.
